On July 9th 2002 I fell out of the back of my work truck and injured my back. Since that time I have realized that the insurance company could care less about my treatment and was more concerned about the bottom dollar.
After repeatedly being pursued by their undercover (something my wife takes great offense to) I saw that they would spend in their best interest but would fight tooth and nail when it came to medical expenses. They said I should voluntarily resign and settle with them.
Well I have found a physician who is prepared to do the necessary spinal fusion but I am forced to take them to court because they state " It is not medically necessary or reasonable ". That I should live in a debilitated state and in constant pain I suppose is? Fortunately for me the Dr. whom is going to do the surgery was actually on the board that wrote the laws concerning Colorado's workers compensation guidelines.
All of the insurance company's so called Dr.'s are from out of state and with no specialization in spinal surgery. My physician questions whether they are actually physicians at all. Meanwhile I have had a year and a half now of being able to do very little. I just recently got myself off all the pain med.'s they had me on. The pain is harder to deal with but I cannot allow myself to be so reliant on narcotics. There has to be something that can be done that will not allow insurance companies to treat us this way.
Even my attorney is left wondering what to do about their obvious neglect. Although she is searching the law books here in Colorado everything seems to have been written to protect the employer with very little concern for those employees who are injured. I have worked over 25 years with a strong work ethic and was proud to be able to support my family. I always believed if I was injured that the people whom I worked for would help me out. What a rude awakening. I have written our congressman with no response.
It does seem a person is alone in this situation.
