Upper Back Injury At Work

I am a 43 year old white female. I was injured in August of 2000.

I was a member of management in a grocery store at the time of injury. I was in and out of work from August till the following June(2001),going to the doctor on a regular basis. Then in June 2001, I was on leave for 12 weeks.

When my doctor released me at that time to go back to work light duty, part-time, I spoke with the store manager and co-manager on three different days about coming back to work and was told they would call me when they had something for me to do with my restrictions. I heard nothing and that is when I filled my suit against my employer. I had not done so before because of fear of losing my job. That is when I found out that my employer had not even filled out an incident report even though I reported the accident the day I got hurt and went to the emergency room.

I found out the November (2001) from my attorney that I had been terminated for failing to return to work after my leave was up. My employer also stated that I was not management. They also stated that I was earning an hourly wage of $8.50 per hour when I was actually earning $10.00 an hour and also stated that I was not a full-time employee. I have been completely out of work since June of 2001.

I have not received any benefits, except for 12 weeks of leave, which my group insurance paid. I lost my group insurance when they terminated me. I have not received any benefits from workers comp or my employer. Workers comp is however paying my doctor bills and my prescription bills. I have also been hospitalized twice during this time for severe depression.

My case has been scheduled to go to court five times and has been changed every time. I am scheduled to go to court again the end of July 2002.
