In October of 1999 I was exposed to a direct spill of benzene on the left side of my face, my face started burning immediately and to this day has not stopped. The Companies and Lawyers kept this claim going for three years an to this day it still is not finished. In the beginning I was suffering from dizziness and pain on the left side of my face.
The administrative Law Judge decided that being poisoned was not enough, I also had a neurologist give a 24% impairment rating, along with my primary physician who said I was 100% disabled. But instead the Law judge would believe the insurance company and their high paid Physicians.
The sad part about it is the Law Judges know that the physicians for the insurance companies are used over and over again, and yet they still make their decisions based on the majority of the Physicians that work for the insurance company.
I am not going to mention the physicians name, but I did some research on this physician and out of at least 100 injured workers, I believe he never gave one positive impairment rating. Yet the Law Judges will take his word over the injured workers Physician, who has nothing to gain but but maybe a $95.00 office visit and telling the truth. This Judge gambled with my live and I lost. I now have swollen lymph nodes on both sides of my neck, and now nodular density of the thorax.
I have been diagnosed with RSD (reflex sympathetic dystrophy) . Which is damage to the nervous system. Here is the shocker. I make $20.23 a week for a 8% impairment rating, for psychosocial damage. My claim is up for reopening on worsening, and I am a nervous wreck.
