I was injured a couple of months ago at the end of the work day.
My supervisor or owner of the remodeling company were not there, so I went home and when I woke up the next morning I could barely move. I went into work and reported it to my supervisor and owner, the owner told me to go home and she would pay me for that day.
When I went back to work the next day I told my supervisor I was going to get checked and he said ok. I went to the emergency room and was treated and told to follow up in three days.
That Friday I got a letter from BWC stating that my employer did not have WC insurance at the time of my injury.
The letter also stated that my coverage would not be interrupted because of this, boy that was a lie.
I pay for my prescriptions and everything has to be pre-approved now because my employer (with no insurance) appealed everything.
I have been off for 2 months now and had an MRI. The Doctors at first med said the MRI showed a herniated disc and bulging discs and made an appointment with a orthopedic (which took 3 weeks to get approved).
I went to the orthopedic and he tells me the only thing he seen on the MRI was a bulge in the center of one of my discs. He is getting me approved for physical therapy as I type and said if that didn't work he would put die in me because the disc could be pushing on the nerve, but for now they are calling it a lower lumbar strain.
It is something that an employer can appeal what I need and me as a injured worker sits around in pain wondering what is wrong with my back and how my bills are going to get paid.
My employer has broken the law by not having workers compensation insurance and nothing has happened to her she has told BWC that she is self insured and for that she has rights, what about my rights.
If you get hurt in Ohio you better beware that your employer will fight you tooth and nail.
I also wrote a letter to the Governor and if I don't get a response I plan to publish the letter along with my remarks in the Columbus Dispatch.
My employer is trying to ruin my creditability to make me look bad, I guess she should have thought about that one before she thought about her criminal record and the fact that she had a previous WC claim without WC insurance that landed her in a civil suit and lost $50,000.
