Back Injury At Work Requiring Surgery
Injured back in 1993, company sent ppd check w/o court approval settlement, had surgery on back 1993, still need surgery for fusion, disc decompression, disc fusion upper and lower.
Company tried to pay and not get court approval, because they knew that would not be approved and i was a salary employee and they didn't think i would sue the company, but i did.
It has took me since 1993 to get this in court, in between time i got involved with fumes, smoke, dust, contaminated air, insufficient venting and got copd, company claims they are not liable but i filed suit and this goes to court 2003 same time as my back, copd 1995.
They can send you all they checks they want to but if they are not court approved settlement they are ineffective settlements. Of course they will be deducted from your award.all workman comp cases have to be court approved.while on your job keep all documentation pertaining to your job, log any hazard areas, fumes, smoke, any thing that would bother your health.
All companys have to provide you a safe place to work.
