Road Equipment Operator Injured On The Job

I am a state road equipment operator for the state of WV. I was injured on the job on Jan.19, 2001. I went to the doctor for 18 months and was misdiagnosed as having just a strain or tendonitis. I missed no work on Comp at the time of injury.

I was finally taken off of work on April 29,2002. Now the state of WV is trying to go back and pay me benefits based on my 2000 earnings which makes that about $400.00 on the month difference than when the day I was injured.

I mean anyone can figure it I am supposed to get 70% of my weekly wages. At the time I was injured I was making $10.72 hr. Which at 70% would be around 60.00 a day and workers comp is only paying me $47.00 a day. That is a big difference.

I have tried to fight with this people but the computer is always right. If anyone out there can tell me where to go to get some help I would be more than grateful. I am standing at loosing everything I have at this time.
